Chamberlain v. City of White Plains, et al.November 19, 2011
The firm represents Kenneth Chamberlain, Jr., the son of Kenneth Chamberlain, Sr., who was fatally shot on the night of November 19, 2011 in his apartment by officers with the White Plains, NY police department. On that evening, White Plains police officers responded to an accidental activation of Kenneth Chamberlain Sr.'s medical alert device. Once the officers arrived on scene, Chamberlain, a 68-year-old former U.S. Marine Corps officer, told the officers that he was fine, and that there was no need for further medical or police assistance. The complaint alleges that several of the police officers ignored both Mr. Chamberlain and the medical alert company's pleas to withdraw the call, and attempted to break down Mr. Chamberlain's front door for over an hour while one or more of the officers uttered racist remarks. According to the complaint, several police officers finally did force entry into Mr. Chamberlain's apartment, and then tasered him upon entry. According to the complaint, after the taser was improperly deployed, one of the officers then fired bean bag bullets from a shotgun. Shortly thereafter, a police officer fired two shots which ultimately killed Mr. Chamberlain, who died several hours later in a local hospital.
The lawsuit names the City of White Plains, the White Plains Housing Authority, and eight members of the White Plains Police Department.
